As many of you may know, the City Council voted on December 7, 2021 to deny an application by Verizon Wireless to install a wireless facility on a replacement wood pole on Carmelo Street between 8th Avenue and 9th  Avenue.   The City Council approved Resolution 2021-084 which I signed denying the Verizon application.  

I want to let you know that Verizon filed a lawsuit against the City which challenges the City’s denial of the Carmelo site application and that lawsuit was served on the City yesterday afternoon.  The Verizon lawsuit and Resolution 2021-084 are available for review.  The City will be represented in the lawsuit by Gail Karish of the Best Best & Krieger law firm who has substantial experience with telecommunications law.
